Emilio Corsetti III
This letter shall serve to confirm the agreement pursuant to which Emilio Corsetti III (the “Author”) has acquired the nonexclusive right and license to reproduce, upon the terms and conditions set forth below, the following photographs/artworks, copies of which have been attached, in connection with a book tentatively titled Heaven and Sea (the “Book”) concerning the ditching of ALM 980 on May 2, 1970.
1. I hereby grant to the Author the following rights with respect to the photographs/artworks.
(a) The non exclusive right to reproduce the photographs/artworks in and conjunction with the Book;
(b) The right to reprint or cause to be reprinted the photographs/artworks in connection with any reprinting, revision, or reproduction of the Book in any language and/or medium whether now known or hereafter devised;
(c) The right to, and to authorize others to, reprint the photographs/artworks in connection with the inclusion of all or part of the Book in any other medium, whether now known or hereafter devised;
2. I represent and warrant that I am the sole author and owner of all rights in and to the photographs/artworks and that the photographs/artworks are original and do not infringe upon any statutory copyright or common law right or proprietary right of any individual or organization.
3. I shall indemnify Author and hold Author (and his licensees, assigns, and successors) harmless against any and all loss, damages, and/or expenses that I may suffer by reason of any claim arising from the breach of any of these representations or warranties made by me.
